Further provisions
As to the further provisions of the 2007 Hague Protocol only a few shall be highlighted here.
Regarding public bodies, the Protocol states that “[t]he right of a public body to seek reimbursement of a benefit provided to the creditor in place of maintenance [is] governed by the law to which that body is subject” (Article 10).
Furthermore it should be noted, that the Protocol provides for a restricted “public policy” exception. Article 13 states that the application of the law determined in accordance with the rules of the Protocol can only be refused “to the extent that its effects would be manifestly contrary to the public policy of the forum”.
