Fair Use Defense in AI Training: A Transatlantic Comparison

This e-presentation compares the US copyright fair use doctrine with the EU legal system in relation to the text and data mining exception as foreseen in the AI Act. These two major exceptions to copyright law apply in very different legal contexts, resulting in completely different approaches on both sides of the Atlantic, particularly with regard to works created through artificial intelligence.
