The e-presentation examines the new proposal for a Directive by analysing its proposed rules on the tracing and identification, freezing, confiscation and management of property within the framework of proceedings in criminal matters. It explains the required steps in the investigation process that need to be conducted within the legislative proposal to freeze and confiscate assets. The new proposed powers and tasks of asset recovery and asset management offices are detailed and the new provisions on the types of confiscation, asset management and disposal as well as victim compensation are highlighted. It concludes with a look at the importance of a strategic framework that the Directive will enable through national strategies as well as cooperation with the European Public Prosecutor’s Office (EPPO), Eurojust, Europol, third countries and within the context of EU restrictive measures (sanctions) to ensure asset freezing and confiscation.
