This presentation examines how existing frameworks of extra-contractual liability address the risks and damages arising from artificial intelligence systems. It explores the relationship between tort law and emerging technologies, identifying key challenges in applying traditional liability concepts to self-learning and autonomous systems. Through a critical analysis of EU legislative initiatives, including the Product Liability Directive, the (revoked) AI Liability Directive, and the AI Act, it highlights current regulatory gaps and procedural issues such as the burden of proof and causation.
